Merchant cash advance debt in Texas

What Texas publishes about UCC filings and commercial financing, and how to check your own record. Informational only, not legal advice.

Your UCC record in Texas

Funders file a UCC-1 financing statement with the Texas Secretary of State SOSDirect UCC to put other creditors on notice. Search it by your exact legal business name. Lien position: a UCC filing names a secured party, not who gets paid first.

Levraq does not read the Texas registry yet, so your report will not list Texas filings. The Debt Check still measures your remittance ratio, stacking and tier from your own answers.

Commercial financing disclosure in Texas

Texas Finance Code Chapter 398, Commercial Sales-Based Financing (HB 700, 2025), effective 2025-09-01, with provider and broker registration required by 2026-12-31: A provider extending a specific offer of commercial sales-based financing must disclose the total financing amount, disbursement amount, finance charge, total repayment amount, estimated repayment period, payment amounts and frequency, other fees, early-payoff charges, collateral and any broker compensation, and obtain the recipient's signature before finalizing. Threshold stated in the statute: specific offers of less than $1,000,000 (§398.051(a)). Source, checked 2026-11-04.

Confession of judgment in Texas

Texas Civil Practice and Remedies Code §30.001: in an instrument executed before suit is brought, a person may not accept service and waive process, enter an appearance or confess a judgment, so a pre-dispute confession clause is ineffective. Source, checked 2026-11-04.

Work the numbers

Two calculators that need nothing from any registry: the annualized cost of an advance, and the share of revenue going to remittances. The Debt Check combines both with what you report.

The cash you actually received.

On the contract, e.g. 1.35 means you repay $1.35 per $1.

UCC coverage is five states (CT, CO, OR, FL, CA) plus SEC filers; no match is not proof of no filing. Informational only, not legal or financial advice. Levraq is a diagnostic and referral service, not a lender, law firm or debt-settlement company. See about.
