Merchant cash advance debt in New York

What New York publishes about UCC filings and commercial financing, and how to check your own record. Informational only, not legal advice.

Your UCC record in New York

Funders file a UCC-1 financing statement with the New York Department of State UCC Search to put other creditors on notice. Search it by your exact legal business name. Lien position: a UCC filing names a secured party, not who gets paid first.

Levraq does not read the New York registry yet, so your report will not list New York filings. The Debt Check still measures your remittance ratio, stacking and tier from your own answers.

Commercial financing disclosure in New York

New York Financial Services Law Article 8, §§801–812 (Commercial Finance Disclosure Law) with 23 NYCRR Part 600, effective compliance required from 2023-08-01: A provider of sales-based financing must disclose at the time of a specific offer the financing and disbursement amounts, finance charge, estimated APR, total repayment amount, estimated term, payment amounts and frequency, other fees, prepayment costs and collateral, in the format the Department of Financial Services prescribes. Threshold stated in the statute: individual transactions over $2,500,000 are exempt (§802(g)). Source, checked 2026-11-04.

Confession of judgment in New York

New York CPLR 3218 as amended in 2019: a confession of judgment may be filed only with the clerk of the county where the defendant's affidavit says the defendant resides, which in practice bars New York confessions of judgment against businesses that do not reside in New York. Source, checked 2026-11-04.

Work the numbers

Two calculators that need nothing from any registry: the annualized cost of an advance, and the share of revenue going to remittances. The Debt Check combines both with what you report.

The cash you actually received.

On the contract, e.g. 1.35 means you repay $1.35 per $1.
